Casey Anthony Defense Strategy Preview – Or at least what it should be!

Admit it! Admit it all!

The strategy that the Casey Anthony defense should take should be as follows in opening statements:

1. The child died in an accident
2. The child was placed in the trunk, with tape to make it look like a kidnapping
3. The child was dumped in the woods
4. Casey tried to hide that an accident happened.

So what! It is not a crime.

Call no witnesses. Tell the jury you will not cross examine any of the prosecution witnesses because you concede it happened and is all true.

The only “evidence” that the prosecution has is that a child died.
Yes, she died.
Yes, she was put in the trunk
Yes, she was put in the woods
Yes, Casey tried to hide it
Agree with the prosecution, point by point, item by item. Yes, she did this, Yes she did that. Yes, yes, yes, yes, we agree with the prosecution. EXCEPT, they have it wrong in how Caylee died. She died like this, and it was an accident. Every time the prosecution calls a witness, stipulate that the defense agrees with why the witness was called and never let them testify! When the prosecution tries to show photos of the child’s body, find some way to agree, she’s dead. Take all of the prosecutions sensationalism away. No emotion for the jury. Calm, matter of fact, this is what happened approach. Make it a quick trial. So much has been beaten into the jury’s head about 8 weeks and their suffering, make it a 1 week trial. Agree, and stipulate prosecution witness testimony is agreed and never let any of them testify. Then depending on where you are, call 1 or 2, or none witnesses. The prosecution, and jury will be buckled! Everyone wants you to argue, if you argue, you lose!

Say, there is only 1 person in this world which knows with certainty, beyond a reason of any doubt, what happened! The prosecution doesn’t know. The media doesn’t know. Only Casey knows, and I am telling you in her words what happened.

The jury wants to hear what happened. Give it to them. Tell them. If the forensics can back up what you say happened, tell them. The prosecution will then shift gears and try to rebut how you say it happened, so be ready for this.

Give the jury a timeline. Use story boards like they did in the OJ case like “Vanaders Big Lies” board. Give the jury every blow by blow detail of the days leading up to the accident, how the accident happened, minute by minute details of the day the child died and how, time line of how she covered it up, her thoughts, fears, time line of every part of the time period! The jury will have no choice but to agree that it was a tragic accident! If you just leave it up for them to decide and take your word for it, then you lose or get hung jury. If you want innocence, you have to give them all the details. You can’t put her on the stand. But you can tell the jury yourself on her behalf.

The only thing Casey Anthony is guilty of, is trying to hide that her daughter died of an accident. With the time served already for the minor charges she will be free.

Remind the jury that the defendant doesn’t have to take the stand or even put on a defense. Tell them you are speaking on Casey’s behalf and she wants you to know what happened. She wants everyone to know what happened. Explain to them how crazy the media was and is. Explain to them why she covered it up (see my other blog below for this). Make everything matter of fact, no big deal. The prosecution is going to try and sensationalize their version. Make your version low key, no big deal, and simple matter of fact.

It’s brilliant! Take away the entire prosecutions case! Trial over in 1 week….Not Guilty!

Simple as that. The prosecution has no case other than a child is dead. Concede it. Not guilty!

    As interesting as Your Theory is, I respectfully disagree.
    It won’t be as simple as that and I do believe Casey Anthony will have to take Responsibility for what happened to her Daughter Caylee.
    Caylee didn’t just simply die.
    It was a Homicide by undetermined Means, never less a Homicide.
    Once All the Evidence will come out in Court, the Jury than will make their Decision and come back with a fair Verdict.
    If our Justice System works as well as I believe it will, there will be Justice for the Victim Caylee Marie in the End. JMO

      Do we know the exact cause of death? How do we know it was a homicide?

      If not, then this opens the door for the defense to give one which suits their version of what happened. I agree, she must take responsibility. Only in my defense strategy, she takes responsibility for an “accident”, and then gives reasons for her not reporting it right away and the ultimate cover up of the accident (see my other blog post a few days ago for this reason).

        It was determined to be a homicide and unless you can prove otherwise don’t discredit the ME’s findings.

    Its a clever argument I admit. However, Ive seen the pool
    and I find it hard to believe that Caylee who was by all accounts quite a well behaved child to climb up that ladder alone and then get into the pool, assuming the ladder was left in place next to the pool and not put away as Cindy stated. I put my daughter in the pool with floaties the way Cindy swam with Caylee as seen in several videos. While children of that age love a pool, they also fear it and I just do not believe a child of Caylees age and disposition would do that. She had her playhouse and her sandbox outside. Would the jury also be asked to believe Caylee moved the ladder as well?
    If Casey moved the ladder and placed it next to the pool and then went inside and left Caylee alone there and she died from that method – I wouldnt call that an “accident”
    I would call it deliberate murder.

    I think I Nailed it spot on, as they say! Accident. The meter reader had some part in it. I didn’t see the George Anthony incest part coming, but how could I!

    George is having an affair and admits to his mistress it was accidental. I think the entire trial hinges on her testimony. Is she believable or not?

    George is not credible and during the defense portion they will discredit him when they can introduce more things as part of the defense.

    Nancy Grace is disgusting I must say. But we all have our opinions and she is “entertainment” and “sensationalism”. So you get what you no is coming. Just what I happen to be watching at the moment so thought I’d comment.

    Interesting indeed. 2 versions. 1 outcome, death of a child. We shall see. Entertaining at least. Sorry that such destructive things in so many peoples lives are “entertainment”. I am sorry for this. I wish it was not. Don’t blame me, blame the people on TV who talk about it and bring it to us.

    I have an open mind, still.

    Of course we should challenge the Medical Examiners findings that it was a homicide. Why shouldn’t we question him? He doesn’t know what happened! Besides, he works for the county and is part of law enforcement to a certain extent. They want someone to pay for this in the worst way and will error on the side of a crime being the cause of death.

      The ME is a woman and is known to most viewers as Dr G. In the absence of a body a Grand Jury was convened in October 2008 and 19 people were presented evidence of premeditation. They charged/indicted her with Felony Murder in the First Degree. Once the body was recovered the ME conclusively declared Caylee Marie Anthony’s death a homicide. (they had the murder weapon)

      It would be reasonable to assume that since you don’t know who the ME is you more than likely never read her autopsy report or those of her colleagues who added substantive analysis relative to the death investigation.

    Caylee drowned in the pool. While it takes a higher-education to fully understand, that is the position of the defense. And, a drowning by accident is not murder, not even a crime at all. 🙂

    It doesn’t matter who the Medical Examiner is. The cause of death is unknown and thus is how it happened. You can’t have one without the other.

    Caylee drowned in the pool and George and Casey did things to throw off the investigation, which under the situation of the abuse, appears quite reasonable. Clearly and certainly no murder ever took place in this case.

      A photo was introduced yesterday by the Defense of a Chloroform photo that Casey’s then boyfriend posted on his Myspace page. The photo was supposed to be funny in that the best way to seduce a woman is by using Chloroform. It showed a hot woman and a guy in a suit at a dinner table and he has some a handkerchief in his hand. It was meaning, don’t wine and dine women, just use Chloroform. The inference is that Casey saw it and did a search on Chloroform. Sounds reasonable to me.

    I hope the jury is more intelligent than these comments which are based on all lies. Casey got the drowning idea from the jailhouse visit when her mother mentioned the drowning idea that she heard on tv. Casey then rolled her eyes and withdrew the idea….but she later thought ‘hey, thats a great excuse!”

    If she is innocent and I cannot say whether she is or not…why would she and her attorney let the case go this far? I understand we are not talking about a normal person here, but if she would have confessed to it just being an accident she would not be on trial for her life. Do you think she thinks this is a game? I could perhaps see where she would think, ‘let them prove I did it, they have no hard evidence’. But why take the chance? Why waste the court’s time and the state’s money? I look forward to reading your comment!

        I never said she was innocent or guilty, what I said was, I could not say whether she was or not. That is for the jury to decide. I am a molestation victim, so apparently you have no idea what you are talking about. I saw the opening statements. I also saw the defense grasping at straws, they could have done better than this. And FYI, most victims do not allow the people which molest them to ‘babysit’ their children. michellefrommadison, what is your trip? Reading is fundamental, before you post, read my posts twice, ok? You are so passionate about something you know nothing of, obviously. Furthermore, if you don’t read your cases, every line and try to comprehend while still in law school, you will never pass any Bar. Are you going to Concord online?

      Innocence is not part of any criminal trial for any defendant. Being found guilty or not guilty is the key term. Innocence does not mean no involvement in any potential criminal incident, it only reflects whether a case can be sustained against a defendant in a court of Law.

    Nancy Grace says Casey Anthony is a victim. June 3rd on Nancy’s only remaining show after she was fired from every previous show, Nancy Grace states that Casey Anthony is a victim, yet Nancy appears upset with that. Perhaps Nancy’s demeanor is induced by her own personal drug-usage or perhaps alcohol usage but it appears Nancy has a high probability of losing even more viewers as Casey’s case get presented so poorly and ineffectively by the prosecution. Perhaps Nancy is in fear again of losing her only remaining television show if Casey if not convicted of first-degree-murder. Which, according to the facts of the case, appears highly probable. Don’t worry Nancy, you can always work in an ice cream shop again or be a beer-taster for your favorite brand.

    As she claims it being an accident, then lets hear it. She drowned in a pool and covered it up?? OK, why cover it up? And even if Caylee accidently drowned. There is clearly no remorse in the days following from Casey. She admits she knew her child was dead, but party, party, party……. Without the legalities of guilty or not, where is the humanity. She looks happy in all her photos with her baby. How could you not grieve that loss, either way? Shes guilty of being heartless.
